OBIA P.C. reserves the right to modify these Terms & Conditions at any time without prior notice. Please carefully read and agree to the following terms and conditions before renting one of our motorcycles.
1. Rental Operator and the Contract
All motorcycle rentals are operated by OBIA P.C. Private Company, located at National Road Paleokastritsas 24, 49100, Corfu, Greece ("OBIA P.C.", "Company", "us", "we"). The participant(s) refers to the person(s) listed on the OBIA P.C. booking form or the person(s) requesting a rental ("Participant(s)", "You").
2. Changes to Rental – Verbal Changes
Any variation of the terms of this rental procedure is only valid if confirmed in writing by both the Participant(s) and an authorized representative of OBIA P.C.
3. Booking
3.1. By completing a rental booking, whether through the online booking form, email, or by signing and sending a booking request via post or fax, you agree to and accept these Terms and Conditions as a binding contract between OBIA P.C. and yourself.
3.2. Once OBIA P.C. receives your booking request, we will send you a written reply (via post, fax, or email) confirming availability, detailing the services included, and specifying the amount to be paid.
3.3. You must make the deposit payment as described in the previous communication (3.2). Once OBIA P.C. verifies that the deposit payment has been received, we will send you a written reservation confirmation via email, post, or fax, at which point a contract ("Rental Agreement"/"Agreement") is established between OBIA P.C. and the Participant(s).
3.4. As a final prerequisite, the Participant(s) must sign the Rental Agreement, which includes a liability release waiver. This document must be signed before the motorcycle is delivered to you.
3.5. OBIA P.C. reserves the right to decline any booking at its discretion.
4. Reservation Deposit & Payments
4.1. Payments may be made by one of the following methods:
PayPal
Electronic bank transfer: Bank details will be provided separately.
Credit/Debit Card: Payments processed through our bank’s e-commerce platform or via PayPal.
Cash: Accepted at the company’s premises.
4.2. A deposit of 30% of the rental value is required to secure your booking.
4.3. Reservation Confirmation: OBIA P.C. is not obligated to hold any motorcycle until the deposit is confirmed. A reservation is only confirmed once you receive written confirmation from us.
4.4. The remaining balance is due upon the Participant's arrival during the motorcycle handover.
5. Pricing
5.1. Rental rates quoted on the OBIA P.C. website or printed materials are valid at the time of writing. OBIA P.C. will notify Participants of any rate increases at least 20 days prior to the rental.
5.2. The rental price includes only the items listed under “What’s Included” on our website and brochures. The following items are not included in the price and are additional costs:
Personal travel, accident, and medical insurance
Personal documentation (e.g., passport, visas if required), fuel, fines, tolls
Additional transportation for you or the motorcycle if it cannot continue beyond the temporary assistance offered by OBIA P.C.
Any other item not specifically included in the price.
6. Travel Insurance
6.1. OBIA P.C. does not provide travel insurance. We strongly recommend obtaining adequate travel insurance, including coverage for medical treatment, accidents, repatriation, holiday cancellation, and curtailment.
6.2. If you choose to travel without adequate insurance, OBIA P.C. will not be liable for any losses incurred.
7. Cancellation by Participant
7.1. Cancellations must be submitted in writing (email or fax).
7.2. Cancellations made between 90 and 45 days before the rental will result in a retention of 30% of the deposit plus €12 per refund transaction as cancellation fees.
7.3. Cancellations made between 44 and 30 days before the rental will result in a retention of 50% of the deposit plus €12 per refund transaction as cancellation fees.
7.4. Cancellations made less than 29 days before the rental will result in the loss of 100% of the deposit.
7.5. Requests to change booking dates, motorcycles, or rental duration will be treated as cancellations and will incur cancellation fees.
7.6. No pro-rata refunds for early returns of motorcycles.
7.7. No refunds for no-shows.
7.8. Trip cancellation insurance is strongly recommended.
8. Cancellations by OBIA P.C.
8.1. OBIA P.C. reserves the right to cancel any reservation due to unforeseen circumstances. If this occurs, the Participant(s) may choose from the following options:
Transfer to an alternative rental period of your choice.
Transfer to an alternative motorcycle model, which may include an additional payment or partial refund.
A full refund of any monies paid.
8.2. If OBIA P.C. cancels a reservation, the Company will not be liable for any additional costs or losses incurred by Participant(s), such as prepaid airline tickets or hotel reservations.
8.3. OBIA P.C. is not liable to provide refunds once the rental commences, regardless of the reason for the Participant(s) being unable to complete the rental period.
8.4. OBIA P.C. cannot be held liable for unfavorable or unsuitable weather conditions, and no refunds will be made due to such conditions.
9. Damage Deposit
9.1. A damage deposit is required at the time of rental collection. The Participant(s) must ensure that the required amount is available on their credit card for the rental period.
9.2. For rentals of up to 14 days, the deposit is held by authorizing a valid credit card. For rentals longer than 15 days, the deposit is charged.
9.3. Only VISA and MASTERCARD credit cards are accepted for authorization. Debit cards may be rejected. Pre-paid cards are not accepted.
9.4. The deposit will be fully released or refunded after a successful inspection of the undamaged motorcycle upon return. If the inspection cannot be completed immediately, OBIA P.C. reserves the right to withhold the deposit until the inspection is completed.
9.5. The release or refund of the deposit is processed by the bank, and the duration of this process is not controlled by OBIA P.C.
9.6. The required deposit amount varies by motorcycle model. Please check the specific model's webpage for details.
9.7. If a valid credit card is not presented, or if sufficient funds are unavailable, OBIA P.C. reserves the right to refuse the rental, and no funds will be reimbursed.
10. Motorcycle Availability
10.1. OBIA P.C. will make every effort to provide the confirmed motorcycle model. If a substitution is necessary, OBIA P.C. will notify you. If you decline the substitution, you may cancel the rental without penalty, and the deposit will be refunded.
10.2. In the event of unforeseen circumstances, including mechanical failure, damage, or theft, OBIA P.C. may substitute the confirmed motorcycle model. If a suitable replacement is unavailable, a prorated refund for the difference in models will be provided.
11. Participant(s) Minimum Requirements
11.1. Minimum Age:
24 years old for up to 48hp (A2 category).
27 years old for up to 850cc models.
30 years old for models over 851cc.
11.2. Riding License:
A2 license for at least 2 years for A2 category.
Full A license for Yamaha Tenere 700 for at least 2 years.
International Driving Permit (IDP) showing class A2/A for non-European license holders.
11.3. By submitting a reservation, you confirm that you have ridden at least 5,000 kilometers (3,000 miles) within the last 3 years. OBIA P.C. reserves the right to terminate the rental agreement on the spot if you do not meet these experience requirements. No refunds will be issued in such cases.
11.4. At the time of motorcycle pickup, you must provide the following current and valid documents:
Passport
Riding license
International Driving Permit (for non-EU citizens)
Valid credit card with sufficient credit for the damage deposit.
11.5. Failure to provide the required documents or a credit card with adequate credit will result in the cancellation of the rental, with no refund of any monies paid.
12. OBIA P.C. Responsibilities
12.1. OBIA P.C. is not responsible for any accidents or injuries incurred during the rental period. The Participant(s) agree that OBIA P.C. and its agents cannot be held liable for any injuries, deaths, or damages resulting from the rental.
12.2. Motorcycles will be provided with new or near-new consumables and a full fuel tank.
13. Force Majeure
In the event of Force Majeure, no refunds or compensation payments can be made. OBIA P.C. and its staff cannot be held liable. Force Majeure includes, but is not limited to, war, riots, strikes, technical problems, airport congestion, terrorist activity, natural disasters, and adverse weather conditions.
14. Errors and Omissions
OBIA P.C. endeavors to ensure that all information on the website and brochures is accurate. However, changes and errors may occur, and OBIA P.C. reserves the right to correct any errors in prices or other details.
15. Complaints
If you have a complaint during your rental, please contact OBIA P.C. immediately. If the issue is not resolved to your satisfaction, you may submit a written complaint within 14 days of your return to info@obia.gr. OBIA P.C. will investigate and respond within 14 days. Failure to follow this procedure may affect your rights under this contract.
16. Jurisdiction
This contract and all matters arising from it are subject to Greek law and the jurisdiction of the Greek courts. If any provision of this contract is deemed invalid, unlawful, or unenforceable, it will be severed from the remaining provisions, which will continue to be valid and enforceable.
Motorcycle Rental Contract
1. Delivery and Collection
The Renter acknowledges receipt of the Motorcycle, having examined it and found it to be in satisfactory condition for the intended purpose.
The Motorcycle, along with all documents, tools, accessories, and equipment provided, must be returned in the same condition at the designated location, date, and time specified in the agreement.
OBIA P.C. reserves the right to repossess the Motorcycle at any time without notice or the Renter’s consent but at the Renter’s expense, if:
a) There is a risk of damage or loss of the Motorcycle, or non-payment of rental charges.
b) The Motorcycle is being used in violation of the agreement.
c) The Motorcycle is being used in violation of Greek laws.
2. Late Return
A 30-minute grace period is allowed after the designated return time.
After the grace period, a full day's rental charge applies.
If the delay causes a subsequent client to miss their reservation, the Renter will be charged an amount equivalent to the lost rental.
After the rental period expires, the Renter assumes civil and penal liability for the illegal use and possession of the Motorcycle.
3. Extension of Rental Period
To extend the rental period, the Renter must notify OBIA P.C. in writing at least 24 hours before the rental period ends.
The extension is only valid upon written approval from OBIA P.C. Otherwise, the terms of Article 2 apply.
The terms and conditions of the initial agreement remain applicable unless otherwise noted during the extension.
4. Damages
4.1. Damage Excess: The Renter is responsible for covering repair costs up to the amount specified as “damage excess” in the rental agreement. If “damage excess” is unchecked or marked as “NO,” the Renter is liable for the full cost of damage or loss.
4.2. Non-Covered Damages: The Renter is fully liable for any damage incurred under the following conditions:
a) Riding in violation of Greek laws or the rental agreement.
b) Riding off-road (additional charges apply as per 6.h).
c) Riding outside Greek borders.
d) Damage during loading, unloading, or transport by any means.
e) Loss or damage to equipment and accessories provided by OBIA P.C.
f) Damage to the lower part of the Motorcycle, including tires and wheels.
4.3. Reporting Damage: The Renter must immediately report any damage or mechanical difficulties to OBIA P.C. and follow given instructions.
4.4. Misuse or Abuse: The Renter is responsible for rental charges for the remainder of the rental period and any costs due to cancellation or postponement of future rentals if the Motorcycle is misused or abused.
4.5. Unusable Motorcycle: OBIA P.C. is not obligated to replace or supply another motorcycle if the rented one becomes unusable. No compensation is provided for unused rental periods.
4.6. Replacement Motorcycle: If OBIA P.C. provides a replacement, additional costs may apply, depending on distance and delivery method. The Renter must approve these costs in writing.
5. Theft
5.1. Theft Excess: The Renter must compensate OBIA P.C. up to the amount specified as “theft excess” in the rental agreement for any theft or loss.
5.2. Full Liability: If no theft excess is specified, the Renter is liable for the full amount required by OBIA P.C.
5.3. Accessories & Equipment: The Renter is fully liable for any theft or loss of parts, accessories, or equipment provided with the Motorcycle.
5.4. Reporting Theft: The Renter must report theft or loss to the nearest police station within 24 hours and notify OBIA P.C. immediately.
6. Additional Charges
The Renter agrees to pay the following charges unless otherwise agreed:
a) Per kilometer charge as indicated in the rental agreement.
b) Refueling charges if the Motorcycle is not returned with a full tank.
c) A non-refundable 40-euro fee for administration and logistics if the Motorcycle is damaged.
d) Any taxes, duties, legal fees, and interest related to the rental or repossession of the Motorcycle.
e) Any fines, penalties, court costs, and a 50-euro administrative fee per fine.
f) Charges for transporting the Motorcycle if returned to a different location without written consent.
g) A 20-euro administration fee for any unpaid tolls.
h) A 150-euro surcharge for off-road use, regardless of distance or rental duration.
7. Use of Motorcycle and Renter’s Responsibilities
The Renter must maintain the Motorcycle in good condition, check its mechanical status regularly, and adhere to prudent riding practices.
Repairs are prohibited without written consent from OBIA P.C.
The Motorcycle must not leave Greece or be loaded onto any transport without written consent.
The Motorcycle must not be used:
a) For carrying passengers or goods for hire.
b) To tow any vehicle or object.
c) To participate in races or rallies.
d) For subleasing.
e) In violation of Greek law.
f) Under the influence of substances that impair driving.
g) In violation of customs, traffic, or other regulations.
h) By anyone other than the Renter and additional driver mentioned in the agreement.
i) For illegal acts or transports.
The Renter is responsible for the ignition keys and liable for replacement costs up to 400 euros if lost or stolen. Express post service costs for spare keys are also the Renter’s responsibility.
If the Renter is unable to return the Motorcycle to the agreed location, the Renter will be charged for relocation costs.
8. Indemnity
OBIA P.C. is not liable for any loss, damage, injury, or death suffered by the Renter or third parties during the rental period. The Renter waives all claims against OBIA P.C. and its personnel.
9. Accidents
In the event of an accident or incident, the Renter must:
a) Not acknowledge liability or accept claims from third parties.
b) Record names and addresses of witnesses and involved parties.
c) Notify the police and ensure care for any injured persons.
d) Contact OBIA P.C. immediately and follow their instructions.
e) Gather relevant information from third parties.
f) Photograph the accident scene if possible.
g) Complete and sign an accident report within 24 hours and send all relevant documents to OBIA P.C.
h) Provide all necessary assistance to OBIA P.C., including court appearances if required.
10. Insurance
10.1. Third-Party Insurance: OBIA P.C. provides insurance coverage up to 1,200,000 euros for third-party injuries and property damage, excluding the Motorcycle driver, provided the Renter does not violate the rental agreement.
10.2. Theft and Damage Coverage: Refer to clauses 4 and 5.
11. Personal Data
The Renter consents to the storage and use of personal data provided in this agreement. OBIA P.C. may share this data with the authorities, if necessary, especially in cases of incorrect statements or violations of the agreement.
12. Miscellaneous
The Motorcycle remains the property of OBIA P.C. This agreement grants the Renter no rights other than those stated.
All additional drivers are jointly liable with the Renter.
Any representative signing on behalf of the Renter is also jointly liable.
This agreement supersedes any prior agreements.
OBIA P.C. cannot waive any rights under the law or this agreement.
Alterations to the agreement must be in writing to be valid.
All terms apply to both the initial rental and any extensions or replacements.
The original copy of this agreement held by OBIA P.C. prevails in case of discrepancies.
All terms of this agreement are considered substantial and fundamental.
13. Jurisdiction
This agreement is governed by Greek law, and all disputes arising from it are subject to the exclusive jurisdiction of the courts of Corfu, Greece.
